The contributions address key cross-cutting questions on the legal status of peace agreements, the potential for developing international law, and the role of key actors - such as non-state armed groups, third-state witnesses and guarantors, and the UN Security Council - in the legalisation and internationalisation of settlement commitments. In recent years, significant scholarly work has examined facets of the relationship between international law and peace settlements, through concepts such as jus post bellum and lex pacificatoria. International Law and Peace Settlements drives forward the debate on the legalisation and internationalisation of peace agreements with diverse contributions from leading academics and practitioners in international law and conflict resolution. The Arab-Israel conflict is a conflict rooted in historical, national, geographic, ethnic and religious elements, and the actors rarely consult international law books before taking action. In the opening chapter of the book, I attempt to answer this question by stating that, although international law is not a dominant factor, nevertheless, it has played a major and, at times, a crucial part in the development of the narratives of the parties and in attempts to solve the disputes. Another problem is that some politicians feel that law is an inhibiting factor." Since its establishment, there has been debate about whether, and to which extent, the Community (now Union) transformed into something else - from an organization established under public international law into a new legal order that has since escaped these international law origins. Early debates about the EU and international law dealt with this question of whether the Union can still be understood as a 'creature of international law'. Later debates focused on the question of how international law applies and is given effect within the EU legal order. These debates were less concerned with the international law origins of the EU, but with whether the EU legal order was 'open' or friendly towards international law. This was influenced by the case law of the European Court of Justice, in which the Union gave internal effect to obligations arising from international law. Klabbers' study on The European Union in International Law, for example, looks inwards to 'investigate how the European Union treats international law." S. Chimni articulates an integrated Marxist approach to international law (IMAIL), combining the insights of Marxism, socialist feminism, and postcolonial theory. The book uses IMAIL to systematically and critically examine the most influential contemporary theories of international law, including new, feminist, realist, and policy-oriented approaches. In doing so, it discusses a range of themes relating to the history, structure, and process of international law. The book also considers crucial world order issues and problems that the international legal process has to contend with, including the welfare of weak groups and nations, the ecological crisis, and the role of human rights. This extensively revised second edition provides an invaluable, in-depth and updated review of the key literature and scholarship within this field of study. It will be of particular interest to students and scholars of international law, international relations, international politics, and global studies." There is a pressing need to address these changes within international legal studies and overcome potential conflicts between existing and emerging powers. This structural transformation also demands a change in understanding of existing ideas and institutions in general. This book explores a 'transcivilizational' approach to international law, supplementing and modifying two other prevalent perspectives: international and transnational. By considering these three layered viewpoints, this book highlights the complex phenomena surrounding the history and development of international law. The author also considers how international law operates and functions within diverse forums such as diplomatic negotiation, international organizations, and domestic political processes. This book will appeal to international law scholars and students, as well as those interested in the rise of non-Western powers and its impact on the prevalent ideas and institutions of the world at large."--Back cover.
