تتناول الدراسة موضوع المقاربة التشاركية في المنظومة القانونية الجزائرية، باعتبارها أحد أبرز التحولات التي أفرزتها التعديلات الدستورية الأخيرة، وتعهدات النظام السياسي في تفعيل أدوار المواطن والمجتمع المدني بوصفه شريكا فاعلا ومحوريا في صنع القرار العمومي التنموي.
تتمحور الإشكالية حول مدى توفيق المشرع الجزائري في تكريس مقاربة تشاركية فعلية، وما إذا كانت النصوص المنظمة لها تحقق الغاية منها، أم أن الواقع الميداني يكشف عن قصور يعيق من تفعيلها.
اعتمد البحث على المنهج الوصفي، والمنهج التحليلي، والاستئناس بالتجارب المقارنة للاستفادة منها، وقد قسمت الأطروحة إلى بابين وفق التقسيم الثنائي، كل باب يتضمن فصلين.
وخلصت الدراسة إلى وجود قصور في تطبيق المقاربة التشاركية وعليه أوصى البحث إلى ضرورة تجسيد إصلاح تشريعي ومؤسسي شامل وفعال يحقق فعلية المقاربة التشاركية
The Participatory Approach in Algeria between Textual Requirements and the Problem of Implementation
This thesis examines the participatory approach within the Algerian legal system, considered as one of the most significant transformations introduced by recent constitutional revisions and by the political commitments aimed at activating the role of the citizen and of civil society as central and effective partners in the making of public developmental decisions.
The central problematic of the study revolves around the extent to which the Algerian legislator has succeeded in establishing a genuine participatory approach, and whether the legal texts governing this matter actually fulfill their intended purpose, or whether the field reality reveals shortcomings that hinder its effective implementation.
The research relies on the descriptive method and the analytical method, complemented by recourse to comparative experiences in order to draw lessons from them. Accordingly, the thesis is structured into two parts following a binary division, each part comprising two chapters.
The study concludes that there are notable deficiencies in the implementation of the participatory approach. On this basis, it is recommended that a comprehensive and effective legislative and institutional reform be undertaken in order to ensure the genuine effectiveness of the participatory approach
