Criminal Law خلاصة : "Currently, there is an engorging fascination with and heightened expectations from international legal accountability. Crimes Against Humanity examines whether international criminal law, in particular legislation and institutions pertaining to war crimes and crimes against humanity, is equipped to be a panacea for the ills of the recalcitrant nation-state system. The main thread that runs through the text is to determine the ultimate aim and efficacy of adjudicating some of the most egregious infractions of the internationally sanctioned human rights regime. While international criminal law strives to develop a shared understanding of, and golden standards for, acceptable behavior of states and governments, it also suffers from a degree of institutional idealism pertaining to current accountability regimes in public international law. Focusing on the Global South, it also examines the problem-laden notion of collective responsibility for societal and political mass crimes and questions the merits of disproportionate reliance on international criminal law in the aftermath of civil wars, ethnic cleansing, genocidal violence, and mass exodus."

Criminal Law خلاصة : Présentation de l'éditeur : "This pioneering book explores the intersections of law and culture at the International Criminal Court (ICC), offering insights into how notions of culture affect the Court¹s legal foundations, functioning and legitimacy, both in theory and in practice. Leading scholars and legal practitioners take a multidisciplinary approach to challenge the view that international law is not limited or bound by a particular culture, arguing instead that law and culture are intertwined. Analysing how culture influences views of the law, the facts to which it applies, and the fairness of the outcome, the contributors consider the implications of culture and law for the ICC and its international reach. Chapters discuss important intersections of law and culture, from religion and politics to the definition of international crimes and their interpretation by judges. Highlighting the inherent but often overlooked role of ©culture¹ at the ICC, the book puts forward recommendations to aid the Court¹s future considerations. This book is a valuable resource for academics and students in a variety of fields including law, criminology, anthropology, international relations and political science. Its practical focus is also beneficial for legal practitioners and civil society organisations working in international criminal justice." عنوان : The failure of the International Criminal Court in Africa نوع الوثيقة : نص مخطوط مؤلفين : Benyera, Everisto, Éditeur scientifique ناشر : New York, NY : Routledge تاريخ النشر : 2022 عدد الصفحات : 188.P Ill. Criminal Law خلاصة : "This book investigates the relationship between the International Criminal Court and Africa, asking why and how the international criminal justice system has so far largely failed the victims of atrocities in Africa. The book explores how the Court degenerated from a very promising multilateral institution to being an instrumentalized, politicized, weaponized institution which ended up with the victims being the greatest losers. Instead of looking at the International Criminal Court as a recent alternative to the prevailing paradigm, that book argues that it is a manifestation of the same world order that was established by the Reconquista in 1492. Written from a decolonial perspective, the book particularly draws on evidence from Zimbabwe in order to demonstrate how the International Criminal Court is failing the victims of the four crimes that falls under its jurisdiction. Drawing on the perspectives of victims in particular, this book highlights the damage caused within Africa by the international justice system and argues for a decolonial concept of justice. It will be of interest to researchers from across African politics, international relations, law, and criminal justice" The failure of the International Criminal Court in Africa [نص مخطوط] / Benyera, Everisto, Éditeur scientifique . - New York, NY : Routledge, 2022 . - 188.P : couverture colorée ; 24. cm.
